NOTICE TO MEMBERS: Selected Independent Funeral Homes (Selected) is the sole and exclusive owner of all advertising mats and materials (“advertisements”) and all informational and advice pamphlets provided in electronic and hardcopy form (“pamphlets”), which are entitled to full protection under the United States copyright laws and federal Lanham act. Your payment is a fully paid-up license fee. You are obtaining a nonexclusive, nontransferable license to use the advertisements and pamphlets. This license does not give you any right, title or interest in the advertisements or pamphlets other than the right to use the advertisements and pamphlets in the precise form and manner prescribed, always including the Selected name, copyright symbol (“©”) and copyright date. Your license and rights to use the Selected advertisements and pamplets shall expire at the end of 15 years OR with voluntary or involuntary termination of your membership in Selected, whichever comes first, and upon such termination, you agree to immediately discontinue all use of the advertisements and pamphlets and destroy any materials already created which include the advertisements or pamphlets, or any materials confusingly similar thereto, and you hereby acknowledge that all rights in the advertisements and pamphlets shall remain the property of Selected. By payment, you acknowledge, understand, accept and agree to the terms of this license, and you agree not to challenge the title of Selected to the advertisements, pamphlets or the validity of this license. Selected has the sole right and discretion to bring infringement or unfair competition proceedings involving the copyright advertisements and pamphlets.

All products sold by Selected are as is. Selected disclaims all warranties with regard to products sold, express or implied, including, but not limited to the implied warranties of merchantability and fitness for a particular purpose. Purchaser’s rememdies are limited to return of the goods purchased and repayment of the price. In no event shall Selected be liable for special, indirect or consequential damages.
